PLEASE READ THESE TERMS OF SERVICE AND END USER LICENSE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING FRAMEMOG (“THE APP”). BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP AND DELETE IT IMMEDIATELY.
This Agreement is a legally binding contract between you (“User,” “you,” or “your”) and FrameMog (“we,” “us,” or “our”). This Agreement governs your access to and use of the FrameMog mobile application, including all features, content, services, and functionality offered through the App.
By creating an account, accessing, or using the App in any way, you confirm that you are at least 17 years of age and that you have the legal capacity to enter into this Agreement. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to this Agreement on your behalf. You agree to be bound by all terms, conditions, and policies referenced herein.
We reserve the right to update or modify this Agreement at any time. Continued use of the App following any changes constitutes your acceptance of such changes. We will notify users of material changes through in-app notifications or via the email address associated with your account.
FrameMog is a self-improvement and community engagement platform that provides:
The App is designed as a self-improvement tool. It is not intended, designed, or permitted to be used to objectify, demean, bully, harass, or rank other individuals in any mean-spirited or offensive manner.
FrameMog maintains an absolute zero tolerance policy for objectionable content and abusive users. This policy is strictly enforced and applies to all content posted, shared, uploaded, transmitted, or otherwise made available through the App, as well as all user conduct within the App.
The following content is strictly prohibited on FrameMog. This list is non-exhaustive, and we reserve the right to determine, in our sole discretion, what constitutes objectionable content:

Violation of this zero tolerance policy will result in immediate and permanent removal of the offending content and may result in immediate suspension or permanent termination of your account, without prior notice or warning. We reserve the right to take any action we deem appropriate in response to violations, including but not limited to reporting illegal activity to law enforcement authorities.
When you use the AI Face Scan feature, the following data is transmitted to a third-party AI service:
No other personal data (such as your name, email, account information, or device information) is sent to the third-party AI service.
Your photos are sent to xAI (the company behind the Grok API) for AI-powered facial analysis. You can review xAI's privacy policy at x.ai/legal/privacy-policy.
xAI processes your two photos solely to generate your AI face scan analysis results. The analysis is returned to the App as structured data containing data points about your facial features, which is then stored in our database and displayed only to you.
xAI does not store or retain your photos after processing is complete. Your photos are used only for the duration of the analysis request and are not kept by xAI.
We require that any third-party service we share user data with maintains protections for your data that are equivalent to or exceed those described in this Agreement and our Privacy Policy. xAI's handling of your data is governed by their privacy policy referenced above.
Before your photos are transmitted to xAI for analysis, the App will clearly disclose what data is being sent and to whom, and will ask for your explicit consent. Your photos will not be sent to any third-party AI service without your permission. You may decline at any time, in which case the AI Face Scan feature will not be available to you.
We employ a combination of automated and manual content moderation systems to enforce our policies and maintain a safe community environment:
You acknowledge and agree that no content moderation system is perfect and that some objectionable content may temporarily appear on the platform before being identified and removed. If you encounter any such content, please report it immediately using the in-app reporting tools.
FrameMog provides in-app mechanisms for users to report objectionable content and abusive users. You may report content or users by using the report function available on any piece of user-generated content within the App.
When you submit a report:
We commit to acting on all reports of objectionable content within 24 hours. This includes removing the offending content and ejecting (suspending or permanently banning) the user who posted the content, as appropriate based on the severity and nature of the violation.
FrameMog provides a blocking mechanism that allows you to protect yourself from abusive users:
You may only upload photos of yourself. By uploading a photo to the App, you represent and warrant that:
By uploading or posting content to the App, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and perform your content solely in connection with operating and providing the App and its services. This license terminates when you delete your content or your account, except to the extent that your content has been shared with other users and they have not deleted it.
We reserve the right to remove, hide, or disable access to any user-generated content at any time, for any reason, in our sole discretion, with or without notice. We are not obligated to store, maintain, or provide copies of any content you upload.
To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate any account at any time, for any reason, including but not limited to violations of this Agreement.
Certain features of the App require a paid subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's terms and conditions for in-app purchases and subscriptions. You may manage your subscription and turn off auto-renewal in your Apple ID account settings. Refunds are handled in accordance with Apple's refund policies.
The App and all of its content, features, and functionality (including but not limited to all information, software, code, text, displays, images, graphics, photographs, audio, video, design, and the selection and arrangement thereof) are owned by FrameMog and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use, subject to this Agreement.
Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any AI-generated analysis, facial assessment, looksmaxxing plan, or aura score provided through the App. All AI-generated content is for entertainment and self-improvement purposes only and should not be relied upon as medical, psychological, or professional advice.
We do not endorse, guarantee, or assume responsibility for any user-generated content posted through the App. Interaction with other users is at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRAMEMOG, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, ANY CONTENT OBTAINED FROM THE APP, OR ANY INTERACTION WITH OTHER USERS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless FrameMog, its owners, operators, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the App; (b) your violation of this Agreement; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; (d) any content you upload, post, or transmit through the App; or (e) any claim that your content caused damage to a third party.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the App will immediately cease, and all content associated with your account may be permanently deleted.
You may terminate your account at any time by deleting the App and contacting us to request account deletion. Termination of your account does not relieve you of any obligations incurred prior to termination, including any payment obligations.
The following sections shall survive termination of this Agreement: Sections 3 (Zero Tolerance Policy), 4 (Third-Party AI Service and Data Sharing), 8.2 (License to User Content), 11 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), and 17 (Governing Law).
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
This Agreement constitutes the entire agreement between you and FrameMog regarding the App and supersedes all prior agreements, understandings, and communications, whether written or oral.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
You may not assign or transfer this Agreement or your rights hereunder without our prior written consent. We may assign this Agreement without restriction.
This Agreement does not create any third-party beneficiary rights.

ACKNOWLEDGMENT AND ACCEPTANCE
BY DOWNLOADING, INSTALLING, CREATING AN ACCOUNT ON, OR USING FRAMEMOG, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT IN ITS ENTIRETY, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY ALL OF ITS TERMS AND CONDITIONS, INCLUDING THE ZERO TOLERANCE POLICY FOR OBJECTIONABLE CONTENT AND ABUSIVE USERS AND THE THIRD-PARTY AI DATA SHARING PRACTICES DESCRIBED IN SECTION 4.
